Obtaining a copy of the Will

If a Will has been written, the Executors should be made aware of where the original is kept - if a solicitor has drawn up the Will then they will usually have a copy.

Executors of the Will are entitled to request a copy of the Will from the solicitor. It's also possible that a bank may be storing the Will. The Executors will have to prove that they are who they say they are (proof of identity) and prove that a death has occurred (death certificate) before the Will is released.

Only Executors of a Will have access to the Will and its contents, but they do not have authority to close accounts or sell assets such as property and shares until the Courts have provided the Grant of Representation, if Probate is required. When the Grant has been issued the Will becomes a public document and anyone can apply to the Court to see a copy.
